DUI Cases in the Montgomery County Court System
After arrest, DUI charges are filed with the local District Court. Your "Preliminary Hearing" will be held in the District Court where you were arrested, within 30 to 60 days of the date of your arrest. A Preliminary Hearing is held in front of a Magistrate Judge, who determines whether there is probable cause to sustain the charges. If so, the charges are sent to the Montgomery County Court Court of Common Pleas, Criminal Division for disposition.
